  • Recommended Motion:

  • Recommended Motion:

    That the Regional Municipality of Waterloo take the following action with respect to proposal P2023-14 Region of Waterloo International Airport Food & Beverage Facilities and Services as set out in report COR-TRY-23-023 dated August 30, 2023:

    1. Accept the proposal of Stockyards Beverage Co. to operate a café at the Airport for a five (5) year term with an option to renew for five (5) additional one (1) year periods;

    2. Amend the 2023-2032 Airport Capital Program to increase project #03609 by $203,000 in 2023 to be financed from the Airport Capital Reserve;

    3. Direct staff to draft the preliminary 2024 Airport Operating Budget and future operating budgets to direct incremental café revenues to the Airport Capital Reserve until the Region’s upfront capital costs are fully recovered.

  • Recommended Motion:

    That the Regional Municipality of Waterloo take the following action with respect to T2023-181 Roof Replacement 150 Main St., Cambridge, Ontario as set out in report COR-TRY-23-024 dated August 30, 2023:

    1. Accept the tender of Flynn Canada Ltd. in the amount of $1,724,840.00 plus all applicable taxes; and

    2. Amend the 2023 Capital Budget for project #74500 to advance capital expenditure of $1,755,200 to 2023 ($1,620,000 from 2024 and $135,200 from 2025) to be financed from the Facilities Lifecycle Reserve.
  • Recommended Motion:

    That the Regional Municipality of Waterloo take the following action with respect to T2023-144 - Regional Road 10 (Herrgott Road) Rehabilitation, Sunset Drive (St Clements) to Regional Road No. 17 (Ament Line), Township of Wellesley, Ontario as set out in report COR-TRY-23-025 dated August 30, 2023:

    1. Accept the tender of Capital Paving Inc in the amount of $3,521,013.20 plus all applicable taxes; and

    2. Increase the budget for Project# 05758 Herrgott Rd, N Limits of St Clements to Ament Line by $936,000 as set out in Appendix A.
  • Recommended Motion:

    That the Regional Municipality of Waterloo take the following action with respect to T2023 - 127 82 Wilson Ave, Kitchener - 6 Storey Residential Development (under PQ2022-10) as set out in report COR-TRY-23-026 dated August 30, 2023:

    1. Accept the tender of Melloul-Blamey Construction Inc. in the amount of $28,227,200.00 plus all applicable taxes;

    2. Amend the Capital Budget for the 82 Wilson Ave project as set out in Appendix A; and

    3. Approve debenture authority for the 82 Wilson Ave project in the amount of $23,615,000 for a term not to exceed 20 years.
  • Recommended Motion:

    That the Regional Municipality of Waterloo increase the contract with Mayhew Inc. for C2022-16 by $1,300,000.00 for a total of $3,110,435.00 plus all applicable taxes as set out in report COR-TRY-23-027 dated August 30, 2023.

  • Recommended Motion:

    The Library Committee recommends as follows:

    1. That the Regional Municipality of Waterloo approve the conversion of the Breslau Satellite Branch to a full-service library branch located in the lower level of the Breslau Community Centre (BCC), as outlined in PDL-CUL-23-011, dated August 15, 2023.
  • Recommended Motion:

    The Administration and Finance Committee recommends as follows:

    1. That the Regional Municipality of Waterloo approve the updated Emergency Management By-Law attached as Appendix A to report HRC-LRE-23-005, dated August 15, 2023.
    2. That the Regional Municipality of Waterloo ratify the following appointments to the Waterloo Regional Heritage Foundation in accordance with report PDL-CAS-23-010, dated August 15, 2023:
      a) Robert Shipley for a term ending June 2026.
    3. That the Regional Municipality of Waterloo approve the pre-budget procurement of vehicles and equipment scheduled for replacement in 2024 as set out in report COR-FFM-23-002 dated August 15, 2023.
    4. That the Regional Municipality of Waterloo take the following action with respect to the 2023 Mid-Year Update as set out in report COR-CFN-23-029 dated August 15, 2023:
      a)
      Receive the 2023 Mid-Year Update that shows implementation and financial progress towards delivery on the Region’s Annual Business Plan, in support of achieving the vision set out by Council in the Strategic Plan 2019-2023; and
      b) Amend the 2023 Tax Supported Capital Budget as set out in Appendix D.
    5. That the Regional Municipality of Waterloo approve the 2023-2027 Strategic Plan as outlined in report CAO-COM-23-003, dated August 15, 2023, as amended.
    6. That the Regional Municipality of Waterloo approve the continuation of electronic participation for members of Council for Council/Standing Committee Meetings as set out in Procedural By-law 22-051, Section 15, as amended, as outlined in report PDL-CAS-23-009, dated August 15, 2023.
      And that the Regional Clerk be directed to provide a proposed cost estimate in the 2024 Regional Budget for Council Chamber technological upgrades to ensure the continuation of electronic participation as an option for both the Public and the Members of Council.
  • Recommended Motion:

    The Community and Health Services Committee recommends as follows:

    1. That the Regional Municipality of Waterloo amend the 2023 Operating Budget for Children’s Services by adding $8,380,262 in expenditure to be funded 100% by the Ministry of Education to support the Canada-Wide Early Learning and Child Care (CWELCC) implementation funding, as outlined in CSD-CHS-23-002 dated August 15, 2023.

    2. That the Regional Municipality of Waterloo approve the 2023 funding allocations of $163,550 under the Cultural Drivers of Tourism Pilot Grant Program, as outlined in report PDL-CUL-23-13 dated August 15, 2023.

    3. That the Regional Municipality of Waterloo take the following action with respect to the proposed property ownership transfer from the Region of Waterloo Community Housing Inc. to the Regional Municipality of Waterloo as set out in report CSD-HOU-23-022 dated August 15, 2023:
      1. Accept the transfer of ownership effective December 31, 2023 or sooner if practicably possible, of two (2) community housing properties comprising 92 units in total at the following addresses: 199 Elm Ridge Drive, Kitchener and 86 Elgin St. S, Cambridge, for nominal consideration to The Regional Municipality of Waterloo;
      2. Direct the Chief Financial Officer to discharge the existing mortgage on title for 86 Elgin St. S, Cambridge, valued at $2,775,936 as of October 1, 2023 plus any related costs, using funding from the Region’s Housing Capital Reserve; and
      3. Direct the Commissioner of Corporate Services and the Commissioner of Community Services to take all necessary actions and execute all necessary documents to complete the transfer of ownership to the satisfaction of the Regional Solicitor.
  • Recommended Motion:

    The Planning and Works Committee recommends as follows:

     

    1. That the Regional Municipality of Waterloo direct and authorize the Regional Solicitor to take the following actions with respect to the expropriation of lands for the construction of a roundabout at New Dundee Road (Regional Road No. 12) and Robert Ferrie Drive, City of Kitchener, in the Regional Municipality of Waterloo, as detailed in report PDL-LEG-23-039, dated August 15, 2023.

      1. Complete application(s) to the Council of The Regional Municipality of Waterloo, as may be required from time to time, for approval to expropriate land, which is required for the construction of improvements at the intersection of New Dundee Road (Regional Road No. 12) and Robert Ferrie Drive, in the City of Kitchener and described as follows:

    Fee Simple Partial Taking:

    I. Part of Lot 1, Beasley’s New Survey, being Part 7 and 8 on 58R-21801, (Part of PIN 03771-0107 (LT)), City of Kitchener, Regional Municipality of Waterloo (20 Reichert Drive, Kitchener);

    II. Part of Block 111, Plan 58M-528, being Parts 1 and 2 on 58R-21801, (Part of PIN 22734-2706 (LT)), Part 1 being subject to an easement as in Instrument No. WR659521 City of Kitchener, Regional Municipality of Waterloo (628 New Dundee Road, Kitchener);

    Temporary Easement – Grading:

    The right and easement, being a temporary easement in gross, for the free and unobstructed, right, interest and easement terminating on the 31st day of December, 2026, for itself, its successors and assigns, and anyone authorized by it, on, over, under and through the following properties for the purposes of excavation, construction, installation, replacement, alteration, grading, and landscaping as required in connection with the construction of a roundabout at New Dundee Road (Regional Road No. 12) and Robert Ferrie Drive, City of Kitchener, and all related improvements, and works ancillary thereto and for such purposes, the free, unimpeded and unobstructed access to the lands at all times by employees, agents, contractors, workers and anyone authorized by it, and vehicles, supplies and equipment at all times and for all purposes and things necessary for or incidental to the exercise and enjoyment of the right and easement:

    I. Part of Lot 1, Beasley’s New Survey, being Parts 6 and 9 on 58R-21801, (Part of PIN 03771-0107 (LT)), City of Kitchener, Regional Municipality of Waterloo (20 Reichert Drive, Kitchener);

    II. Part of Block 111, Plan 58M-528, being Parts 3 and 4 on 58R-21801, (Part of PIN 22734-2706 (LT)), Part 3 being subject to an easement as in Instrument No. WR659521, City of Kitchener, Regional Municipality of Waterloo (628 New Dundee Road, Kitchener);

    2. Serve notices of the above applications(s) required by the Expropriations Act (the “Act”);

    3. Forward to the Chief Inquiry Officer any requests for a hearing that may be received within the time prescribed by the Act;

    4. Attend, with appropriate Regional staff, at any hearing that may be scheduled;

    5. Discontinue expropriation proceedings or any part thereof, in respect of the above described lands, or any part thereof, upon the registration on title of the required documentation to complete a transaction whereby the required interests in the lands are conveyed or if otherwise deemed appropriate in the opinion of the Commissioner of Engineering and Environmental Services and the Regional Solicitor; and

    6. Do all things necessary and proper to be done and report thereon to Regional Council in due course.

     

    2. That the Regional Municipality of Waterloo approve the expropriation of lands for improvements at the intersection of Sawmill Road (Regional Road No. 17) and Ebycrest Road (Regional Road No. 17), Township of Woolwich, in the Regional Municipality of Waterloo, as detailed in report PDL-LEG-23-036, dated August 15th, 2023, described as follows:

    Fee Simple Partial Taking:

    I. Part of Lot 70, German Company Tract, being Part 1 on 58R-21638, (Part of PIN 22710-0126 (LT)), Township of Woolwich, Regional Municipality of Waterloo (629 Sawmill Road, Woolwich);

    II. Part of Lot 70, German Company Tract, being Parts 2 & 3 on 58R-21638, (Part of PIN 22710-0130 (LT)), Township of Woolwich, Regional Municipality of Waterloo (515 Sawmill Road, Woolwich);

    III. Part of Lot 70, German Company Tract, being Part 4 on 58R-21638 (Part of PIN 22247-0059 (LT)), Township of Woolwich, Regional Municipality of Waterloo (544 Sawmill Road, Woolwich);

    IV. Part of Lot 71, German Company Tract, being Part 5 on 58R-21638, (Part of PIN 22710-0155 (LT)), Township of Woolwich, Regional Municipality of Waterloo (5 Kraft Drive, Woolwich);

    And that staff be instructed to register a Plan of Expropriation for the property within three months of the granting of the approval to expropriate the property, as required by the Expropriations Act;

    And that the registered owners be served with a Notice of Expropriation and a Notice of Possession for the property after the registration of the Plan of Expropriation and the Regional Solicitor is authorized to take any and all actions required to enforce such Notices including but not limited to any application pursuant to Section 40 of the Expropriations Act;

    And that the Regional Solicitor is authorized to enter into an agreement with the registered owners, or to make an application under Section 39 of the Expropriations Act, to adjust the date for possession specified in the Notice of Possession as may be required;

    And that all above-referenced fee simple partial takings situated adjacent to an existing Regional public highway be acquired for road widening purposes and therefore be deemed to form part of the adjacent public highway in accordance with subsection 31(6) of the Municipal Act, 2001;

    And that if no agreement as to compensation is made with an owner, the statutory Offer of Compensation and payment be served upon the registered owners of the property in the amount of the market value of the interests in the land as estimated by the Region’s appraiser in accordance with the Expropriations Act;

    And that the Regional Solicitor be authorized to execute any Indemnity agreement or other document related to payment of the statutory Offer of Compensation;

    And further that the Regional Solicitor be authorized to discontinue expropriation proceedings or any part thereof, in respect of the above described lands, or any part thereof, upon the registration on title of the required documentation to complete the transaction or if determined by the Commissioner of Transportation and Environmental Services that such lands, or any part or interest thereof, are not required for the subject Project.

     

    3. That the Regional Municipality of Waterloo extend the contract with Kiwanis Transit for the operation of the local transit circulator route in the Town of Elmira from September 1, 2023 to August 31, 2024 at an estimated annual cost of $125,000 as set out in report TSD-TRS-23-008, dated August 15, 2023.

    4. That the Regional Municipality of Waterloo approve the Recommended Design Alternative for a proposed single lane roundabout at Dickie Settlement Road (Regional Road No. 71) and Roseville Road (Regional Road No. 46), North Dumfries Township, as described in Report EES-DCS-23-007, dated August 15, 2023.

    Upon completion of construction, that The Regional Municipality of Waterloo amend Traffic and Parking By-law 16-023 and the Controlled Access By-law #58-87 as amended to:

    a. Remove from Schedule 17, Rates of Speed, 80 km/h on Dickie Settlement Road (Regional Road 71) to Roseville Road (Regional Road 46);

    b. Add to Schedule 17, Rates of Speed, 60 km/h on Dickie Settlement Road (Regional Road 71) from 400 m north of Roseville Road (Regional Road 46) to Roseville Road (Regional Road 46);

    c. Remove from Schedule 17, Rates of Speed, 80 km/h on Roseville Road (Regional Road 46) from 500 m east of Fischer Hallman Road (Regional Road 58) to 400 m west of Edworthy Side Road (Regional Road 71);

    d. Add to Schedule 17, Rates of Speed, 80 km/h on Roseville Road from 500 m east of Fischer Hallman Road to 400 m west of Dickie Settlement Road (Regional Road 71);

    e. Add to Schedule 17, Rates of Speed, 60 km/h on Roseville Road (Regional Road 46) from 400 m west of Dickie Settlement Road (Regional Road 71) to Cambridge Boundary (1200 m East of Brown Avenue); and

    f. Add to Schedule 10, Level 2 Pedestrian Crossover, on Dickie Settlement Road (Regional Road 71) at Roseville Road (Regional Road 46), On All Entry and Exits.

    g. Two permanent right-in/right-out residential accesses. One existing access on the north side of Regional Road #46 (Roseville Road) and one new access on the east side of Regional Road 71 (Dickie Settlement Road) for the property known municipally as 1746 Roseville Road, North Dumfries Township.

    5. That the Regional Municipality of Waterloo approve the recommended design alternative for a proposed single lane roundabout at Roseville Road (Regional Road 46) and Edworthy Side Road (Regional Road 71) in the Township of North Dumfries, as described in Report EES-DCS-23-005, dated August 15, 2023.  Upon completion of construction, that The Regional Municipality of Waterloo amend Traffic and Parking By-law 16-023, as amended to:

    a. Remove from Schedule 17, Rates of Speed, 80 km/h on Edworthy Side Road (Regional Road 71) from Roseville Road (Regional Road 46) to 300 metres north of Cedar Creek Road (Regional Road 97);

    b. Add to Schedule 17, Rates of Speed, 80 km/h on Edworthy Side Road (Regional Road 71) from 400 metres south of Roseville Road (Regional Road 46) to 300 metres north of Cedar Creek Road (Regional Road 97);

    c. Add to Schedule 17, Rates of Speed, 60 km/h on Edworthy Side Road (Regional Road 71) from Roseville Road (Regional Road 46) to 400 metres south of Roseville Road (Regional Road 46);  

    d. Add to Schedule 10, Level 2 Pedestrian Crossover, Roseville Road (Regional Road 46) at Edworthy Side Road (Regional Road 71), On All Entry and Exits.

     

    6. That the Regional Municipality of Waterloo approve the Recommended Design Concept for the proposed reconstruction of Lancaster Street between Wellington Street and Bridgeport Road in the City of Kitchener as outlined in Report EES-DCS-23-004 dated August 15, 2023.

    Upon completion of construction, that The Regional Municipality of Waterloo amend Traffic and Parking By-law 16-023, as amended to:

    a. Amend Traffic and Parking By-law 16-023 to add to Schedule 22, Reserved Bike Lanes on both sides of Lancaster Street (Regional Road 29) from Wellington Street to Bridgeport Road, in the City of Kitchener as outlined in Report EES-DCS-23-004.

    b. Amend Traffic and Parking By-law 16-023 to delete from Schedule 2, Limited Parking on west side of Lancaster Street (regional Road 29) from Elizabeth Street to 45m north of Guelph Street, in the City of Kitchener as outlined in Report EES-DCS-23-004.

    c. Amend Traffic and Parking By-law 16-023 to delete from Schedule 4, No Stopping on east side of Lancaster Street (Regional Road 29) from Union Street to Ash Street, in the City of Kitchener as outlined in Report EES-DCS-23-004.

    d. Amend Traffic and Parking By-law 16-023 to add to Schedule 1, No Parking on west side of Lancaster Street (Regional Road 29) from Elizabeth Street to 45m north of Guelph Street and on east side of Lancaster Street (Regional Road 29) from Union Street to Ash Street and Arnold Street to 45m north of Guelph Street, in the City of Kitchener as outlined in Report EES-DCS-23-004.

    7. That the Regional Municipality of Waterloo take the following action with respect to the renewal of the Waterloo Region Economic Development Corporation Partnership Agreement subject to 2024 Budget approval as set out in report CAO-23-004 dated August 15, 2023:

    a. Approve in principle the draft Waterloo Region Economic Development Corporation (WREDC) Partnership Agreement as attached in Appendix A; and

    b. Include an incremental $500,000 in funding for the WREDC starting in 2024 funded from the Regional property tax levy.

    8. That the Regional Municipality of Waterloo opt out of administering blue box service as of the Region’s transition date on March 2, 2024, at which time it will be incumbent on the producers to arrange for alternative blue box collection and processing until the end of transition, December 31, 2025; and,

    That staff be authorized to negotiate and execute agreements with existing contractors to continue collection and processing of non-eligible sources not covered in the new blue box regulation, to ensure continuity of services to sites currently receiving collection, until the end of transition, as outlined in report EES-WMS-23-004, dated August 15, 2023.

     

    9. That the Regional Municipality of Waterloo extend the collaborative funding agreement with the Cities of Cambridge, Kitchener and Waterloo for an additional five year period to fund ClimateActionWR, requiring a total contribution of $315,380, as outlined in report PDL-CPL-23-024, dated August 15, 2023.

    10. That the Regional Municipality of Waterloo extend the collaborative funding agreement with area municipal and utility partners for an additional four year period to continue the implementation of the Community Energy Investment Strategy, requiring a total contribution of $358,768, as outlined in report PDL-CPL-23-025, dated August 15, 2023.

    11. That the Regional Municipality of Waterloo enter into a Consulting Services Agreement with HDR Corporation for the Waterloo Landfill Waste Transfer Station Renewal, Waterloo, Ontario, in the amount of $11,958,177.00 plus all applicable taxes, as outlined in report EES-DCS-23-006, dated August 15, 2023.

  • Recommended Motion:

    The Closed Committee recommends as follows:

    1. That the Regional Municipality of Waterloo appoints, and requests approval from the Minister of Health for, Dr. Adelle Chang On as an Associate Medical Officer of Health for the Region of Waterloo, as outlined in report PHP-SPS-23-002, dated August 15, 2023.

    2. That the Regional Municipality of Waterloo:

      1. Support, in principle, the implementation of a Conestoga College Universal Transit Pass (U-Pass) program as early as September 2024 on the same terms and Fee Schedule as the existing U-Pass programs with university student associations, as well as the transit service improvements necessary to accommodate demand, subject to 2024 Budget approval; and
      2. Direct staff to prepare a follow-up report and any associated recommendations after Conestoga College Students Inc.’s student referendum and the Region’s 2024 Budget process are complete.

    3. That the Regional Municipality of Waterloo lease 34 Peel Street, New Hamburg (the “Property”) to Love Your Neighbourhood Communities, a non-profit organization, on a net basis for $1.00 per year base rent plus taxes and utilities thereon, and on the terms and conditions set out in the lease agreement;

    And that the Commissioner, Corporate Services be authorized to execute the said lease agreement, and any related documents necessary to implement this lease, subject to the approval of the Regional Solicitor.

  • Recommended Motion:

    WHEREAS the Region of Waterloo’s Countryside Line is a boundary that protects the cultural, economic, and environmental heritage of our rural lands from the pressures of urban sprawl, and

    WHEREAS, the Countryside Line protects the distinctiveness of rural communities from annexation for suburban residential expansion, and

    WHEREAS, Regional Council acknowledges and understands the importance of our rural communities and the contributions particularly with food security, green space and economic development, and

    WHEREAS as long as Bill 23 has not yet received Royal Assent and therefore is not in force, and

    WHEREAS the existing and unchanged policy 2.C.3.3 allows the Region to adjust an Urban Area boundary at any time not just during a comprehensive review

    THEREFORE be it resolved that Council reaffirm the concept of no new residential areas in the countryside line and it directs staff to explore removing the equivalent amount of land, 70ha, from the urban area and adjusting the countryside accordingly in order to compensate for the Province’s forced expansion.

  • Recommended Motion:

    WHEREAS, the Region of Waterloo has a strategic focus of creating Healthy, Safe Inclusive Communities for the well being and prosperity of all its residents, which includes access to basic needs and opportunities to improve health;
    WHEREAS, social assistance recipients are living in extreme poverty and food insecurity and are at great risk to develop associated health issues; 
    WHEREAS, Ontario Works (OW) and Ontario Disability Support Program (ODSP) rates are below Canada’s Official Poverty Line and since social assistance rates were reduced by 21.6% in 1995, rate increases have been nominal, representing an approximate 10% increase over 26 years;
    WHEREAS, Ontario Works rates have not been increased since 2018 and are not indexed to inflation causing further income inequality, poverty, and housing unaffordability;
    WHEREAS, use of food banks in Waterloo Region has increased by 45% since June of 2022. Evidence continues to show that food-based programs do not resolve food insecurity because it is an inadequate income problem, much bigger than just food. Many of the residents accessing local food banks are employed;
    WHEREAS, a Basic Income program was tested in Hamilton, Brantford, and Brant County from 2017 to 2019 as part of the Ontario Basic Income Pilot project and research shows that all the recipients in the pilot project who received the basic income reported benefitting in some way. Many reported improvements in their physical and mental health, labour market participation, food security, housing stability, financial status, and social relationships; 
    WHEREAS, the downstream effects of increasing poverty is putting unsustainable pressure on municipalities limited resources;
    WHEREAS, the provision of a Guaranteed Liveable Basic Income would benefit individuals, families, and communities and protect the most vulnerable in society, it would also support community resilience by facilitating the transition to a local economy that responds to the climate crisis and other major challenges. 
    WHEREAS, evidence shows that a federally funded basic income is possible, as successful income programs already exist in Canada for seniors (Old Age Security and the Guaranteed Income Supplement) and for families with children (Canada Child Benefit CCB);
    WHEREAS, the Federal budget Office upon reviewing the concept of a national Guaranteed Basic Income program determined it could, if properly set out, be a major economic driver to the Canadian economy; and
    THEREFORE BE IT RESOLVED
    (a)That the Region of Waterloo asks the provincial government to increase Social Assistance rates for both OW and ODSP to reflect the costs of living and to tie these rates to inflation. 
    (b)That the Region of Waterloo supports the concept of a Guaranteed Liveable Basic Income to combat poverty, income inequality, and economic insecurity.  
    (c) That the Region of Waterloo calls on the provincial and federal governments to collaborate to implement a national Guaranteed Liveable Basic Income program.
    (d)That the Regional Council directs the Regional Chair to write a letter to the Prime Minister, local Members of Parliament, and the Senate, the Premier of Ontario, local members of the Legislative Assembly of Ontario, calling on these orders of government to work collaboratively towards implementing a National Guaranteed Liveable Basic Income to eradicate poverty and homelessness, and through their representatives ensure everyone in Canada  has sufficient income to meet their basic needs.
    (e) That the Region of Waterloo encourages other cities and regions to advocate for a Guaranteed Liveable Basic Income to their MPs and MPPs and at both Association of Municipalities of Ontario (AMO) and the Federation of Canadian Municipalities (FCM).
